DRIVING UNDER THE INFLUENCE
Driving Under the Influence (DUI) cases always involve serious collateral consequences. After a person is arrested for DUI in Utah, a request for a driver’s license hearing must be made in writing within ten days or the license will automatically be suspended. The driver’s license hearing involves technical issues and defenses that require the assistance of counsel experienced in DUI defense.
The DUI criminal charge is completely separate from the driver’s license hearing. It also involves technical evidentiary requirements and potentially complex defenses. In Utah there are a number of mandatory requirements in sentencing some of which may be avoided with effective advocacy either in court or in plea negotiations. Experienced and competent defense counsel is necessary for a person charged with a DUI.
